TERMS AND CONDITIONS
The following terms and conditions apply to your enrolment into the Janssen Immunology Patient Support Programs (the Program).
The Program is sponsored by Janssen-Cilag Pty Limited (Janssen) and administered by Aesir Health Pty Limited, and any other third-party service providers Janssen may engage from time to time (the Program Managers). Program Managers may also engage third party services providers (Program Service Providers) to provide certain services.
The Janssen Immunology Patient Support Program consists of the following options:

Set up reminders to keep track of appointments, medication doses, and 1:1 program support calls.

Choose to have certain medical supplies sent to your nominated address.

For eligible gastroenterology patients, book your nurse visit for your first infusion as well as home-training for ongoing STELARA treatment.

For eligible gastroenterology patients, choose to have your medication delivered to your door.
About your Treatment:

Participation in the Program is open to patients who have been prescribed:

  • SIMPONI™ (golimumab)
  • TREMFYA™ (guselkumab)
  • STELARA™ (ustekinumab)
    (together the Medications, each a Medication).

Your Medication was prescribed by your healthcare professional (HCP) and the monitoring of the treatment is carried out by them.

Any information, advice and directions provided to you by the Program, any Support Nurse, Program service provider, or Janssen is general in nature, does not replace the diagnosis or medical treatment indicated by your HCP, and must not be relied on or interpreted as medical or other advice in relation to your condition or the Medications.

You should always discuss any concerns or questions you may have regarding your health or the relevant Medication with your HCP.

You agree and understand:

The risks associated with the Medication(s) you have been prescribed have been explained to you by your HCP. If you notice any side effects or adverse reactions, you will immediately inform your HCP.

The Program Managers are legally obliged to pass on details of any adverse event, special situation, or product quality complaint to Janssen, and you understand that Janssen or an authorised third party may contact you or your HCP for the purpose of an adverse event, special situation or product quality complaint follow up.

All communications with you as part of any Program will be provided by the Program Managers, a registered nurse provided by the Program Managers (Support Nurse) , other Program Service Providers or Janssen.

Your participation is voluntary, and you can withdraw from the Program at any time. Additionally, your HCP may recommend that you withdraw from the Program if it will no longer be beneficial to you or they otherwise decide you should no longer participate.

You will notify the relevant Program Manager as soon as possible if you stop being prescribed your Medication or if the HCP prescribing your Medication changes.

Janssen may change these terms and conditions, including the Privacy Policy and Collection Statement, or the Program may be terminated or modified by Janssen at any time. The Program Managers will use reasonable endeavors to notify you of any changes. Janssen reserves the right to exclude or remove participants who are not eligible to use the Program (e.g., because they are no longer being prescribed a medication).

Caregivers:

These terms and conditions, and relevant consents in relation to personal information, may be accepted and given by a patient’s caregiver if the patient is under the age of 18 or otherwise nominates a caregiver.

In these circumstances, where these terms and conditions are describing a legal obligation, references to a patient or “you” should be read as referring to the caregiver.

Each Caregiver acknowledges and agrees that Janssen will collect, store, use and disclose his or her personal information to contact the patient and otherwise for the purpose of delivering the Program in accordance with these Terms and Conditions, Privacy and Collection Statements.

Services:

The services provided under the Program may vary depending on the Program information provided; and your needs, depending on your Medication. Depending on the services you choose, you consent to the Support Nurse or a Program Service Provider:

  • contacting you via SMS, phone or email to remind you to arrange appointment times for treatment and provide appointment reminders, including leaving voicemails if you have chosen a phone reminder;
  • contacting you if further details are required regarding your prescription, and providing these details to other Program nurses for the purpose of administering a Program for you;
  • attending you at an agreed location to provide Medication administration education and support, or if you are a gastroenterology patient being prescribed Stelara and, are eligible, infusion services;
  • obtaining your Medication treatment chart from the HCP that prescribes your Medication; and
  • contacting or attending you for any other purposes related to the administration of the Program for you.

If you elect to receive a Patient Pack, medical supplies or, if you are being prescribed Stelara and enrolled into home infusion, your Medication, you consent to the Program Managers or a Program Service Provider sending this to your chosen address.

Other important Terms and Conditions:

The cost of each Program is funded by Janssen, and neither your HCP nor any healthcare professional engaged in the management of your health is provided with payment of any kind for using any Program or suggesting that you enrol in a Program.

You understand that from time to time, the Program Managers and/ or Janssen may contact you to get feedback about your experience of a Program. This is to help improve the Program and increase the satisfaction of the participants.

If you have any questions, complaints or claims in relation to any Program you should contact the Program Managers on the details provided below.

These Terms and Conditions are governed by the laws in New South Wales and if any of these Terms and Conditions is invalid, unenforceable or illegal, that term will be struck out and the remaining terms will remain in full force.

  • calling Aesir Health on 1800 666 845;

PATIENT PRIVACY STATEMENT
To enrol you in the Program, we need your consent to the enrolment terms and conditions and to the collection, storage, use and processing of your personal and sensitive health information by Janssen, its Program Managers and Program Service Providers. Depending on how you choose to enrol, you can provide your consent either by email, signing the enrolment form or ticking the relevant box on the Online Portal.

For Janssen to run the Program and provide these Program services, it is very important that you agree to the collection, storage, use and processing of your information in these ways.
You are under no obligation to provide your consent and you can decide not to participate in the Program if you do not wish to share this information.
You can also withdraw your consent at any time and the necessary steps will be taken to remove you from the Program and to delete your information.

How long will we store your data?

The data will be stored for the time necessary to fulfill the purposes of the Program you choose and are eligible to enrol into (Janssen Immunology Patient Support Program).
The data may be used, shared, analyzed and overall processed locally and/or internationally by Janssen, its affiliates and/or subsidiary companies, strategic allies, pharmacies, distributors, service provider companies and entities within the healthcare system.

Important Privacy Information:

You are enrolling into the Janssen Immunology Patient Support Programs. Janssen, as sponsor of the Program, has engaged the Program Managers to manage and deliver the Program.

In order to enrol into the Program, you need to provide the Program Manager(s) and Janssen with your personal information (which includes sensitive health information regarding your health and medical history).

You consent to your personal information being collected, used, stored, disclosed, and processed by Janssen in accordance its privacy policy, the Patient Support Program Collection Statement and the Privacy Act 1988 (Cth), for the purpose of arranging and managing the Program and to provide you with services and resources relating to your condition and ongoing health needs, including by disclosing your personal information to the Program Managers (and any contracted service provider in its place).

You consent to the Program Managers (and any contracted service provider in its place) collecting, using, disclosing and storing your personal information in accordance with its privacy policy and the Privacy Act 1988 (Cth). You consent to the Program Managers providing your personal information to Janssen, the Support Nurse providing the services, your carers (if applicable), your doctors, nurses and case managers, and to any Program Service Providers engaged by the Program Managers from time to time to assist in carrying out the Program.

You understand and acknowledge that Janssen may use certain de-identified data (including de-identified data provided by the Program Manager(s)) from the Program for research, understanding Program trends, and to let physicians know how the Program is performing. Publication of such metrics may be used at health care professional educational symposia, and you understand and acknowledge that any such publication will not identify you individually.

You consent to your personal information being collected, used, processed, disclosed and stored by Janssen in accordance with its privacy policy, the Patient Support Program Collection Statement, and the Privacy Act 1988 (Cth). You understand that Janssen shall collect, use, process, disclose and store your personal information as described in the Janssen Privacy Policy, which also includes information about how you can request access to or correction of your personal information, opt out of services or communications, or make a privacy complaint.

You consent to your personal information being disclosed to, used and processed by Janssen’s personnel, global affiliates and Program service providers who utilise Janssen’s patient support database or support the operation of patient support programs. Those third parties are located in Australia and overseas, including in Singapore, Japan, South Korea, and the USA, and are subject to contractual measures to safeguard and protect your personal information consistent with Australian privacy laws.

You consent, for the purposes of the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth), to Janssen and the Program Manager(s) using your personal information to send you communications regarding existing and new products and services, and other communications requested by you, including via email and SMS.

Janssen Immunology Patient Support Program Collection Statement
Your personal information will be disclosed to Janssen-Cilag Pty Ltd ACN 000 129 975 (Janssen) and its global affiliates. Janssen collects your personal information through the Program Manager of the Janssen Immunology Patient Support Programs (PSP) into which you have enrolled, or directly from your healthcare professional (HCP). The Program Manager or your HCP will disclose this information to Janssen for storage in a database which may be located overseas, and is operated by Janssen or its affiliates. Janssen is responsible for the management of the personal information so collected.
The information we collect:

The personal information collected by Janssen includes:

  • your name;
  • your address;
  • your date of birth or age;
  • your gender;
  • your medical history in relation to your Medication;
  • your health details such as height and weight, allergies, infections;
  • your contact telephone number;
  • your email address;
  • your carer’s name and contact details (if applicable);
  • your prescribing doctor’s name, practice address and other contact details;
  • information regarding which Janssen product you have been prescribed;
  • information regarding your present disease state;
  • information regarding services which are provided to you under the PSP; and
  • other information which is necessary for the effective operation of the PSP.
How we may use your information:

Janssen, through the Program Manager, is collecting such personal information for the purposes of you participating in the PSP, and to create a database of patients participating in this PSP and other patient support programs operated by Janssen. Depending on the services you choose to enrol in, Janssen may use your personal information to:

  • make available to you appropriate educational, support and other materials;
  • understand any risks, challenges and positive outcomes from the PSP;
  • provide products and services to you and send communications requested by you (including via email, mail, SMS, telephone or via the online portal);
  • update you with news, information or advice about its existing and potential new PSP related products and services;
  • share information with you regarding home delivery services or nearest pharmacies to you;
  • suggest nearby specialists that you can speak to for further information;
  • provide you with a welcome kit to the PSP;
  • understand the extent to which support, such as nurses or other allied health professionals, may be needed by you;
  • provide information to you on your disease and/or therapy, such as management of side effects;
  • review your information to potentially propose additional services, support groups or other suggestions that you might benefit from;
  • provide guidance to you and your prescribing doctor about other patient support programs that might benefit you;
  • make suggestions to your or your treating doctor, based upon historical data and your characteristics, to ensure quality use of medicines and targeted disease management approaches;
  • provide you with customised reminders for dosages and other messaging;
  • understand future capacity and other requirements of physical support and case manager services, such as nurses; and share relevant answers and discussion in the patient community with you.
De-identified, aggregated personal information:

We may also use your de-identified personal information, aggregated with that of other participants in the PSP to:

  • assess the impact of the PSP on initiation and medicine adherence;
  • evaluate the effectiveness of a patient support program;
  • evaluate any potential characteristics that suggest patients may fail to start therapy and suggest or provide pro-active solutions;
  • customise and optimise services under the PSP to maximise its impact, engagement and patient experience;
  • predict the requirement, frequency and method of administering injection training to optimise its effectiveness;
  • evaluate any potential characteristics that suggest that adherence to medicine dosage may be improved and prioritise delivery of associated services;
  • analyse utilisation of the PSP services to help guide design and implementation of future patient support programs; and
  • identify critical points of discontinuation of patients based on persistency and adherence behaviours.
Who else may see your information:

To the extent necessary for achieving the purposes stated above, your personal information may be disclosed by Janssen to, and used by the Program Manager and Program Service Providers of the PSP, your doctors, nurses, and care managers who engage in providing services under the PSP.

Janssen sometimes engages third party organisations to undertake research including clinical studies, real world evidence studies and market research in order to improve the Australian scientific understanding of how certain conditions affect the lives of patients and to ascertain the effectiveness of patient support and similar programs. Third parties engaged by Janssen may contact you from time to time to see if you are interested in hearing more about or being involved in relevant studies or research. Any such third parties engaged by Janssen will be provided with your name, phone number and email address only so that they can contact you to discuss the study or research and your potential eligibility. You do not have to participate in any study or research and whether you participate or not will not affect your treatment or enrolment in the patient support or similar program.

Your personal information may also be disclosed to, and used by Janssen’s personnel, global affiliates and contracted service providers who utilise Janssen’s patient support database or support the operation of PSPs. Those third parties are located overseas, including in Singapore, Japan, South Korea, and the USA, and are subject to contractual measures to safeguard and protect your personal information consistent with Australian privacy laws.

The Privacy Act 1988 requires you to be notified when your personal information is collected, stored, used or disclosed. You consent, for the purposes of the Privacy Act and the Spam Act, to Janssen using your personal information to send you communications regarding existing and new PSP related products and services, and other communications requested by you, including via email and SMS.

Subject to some exceptions permitted by law you may be able to request access to, correction of, or suspension of use or provision of, your personal information.
